Proposed rule would require domestic and foreign FAA-certificated repair stations to implement enhanced security measures. It would also give TSA authority to audit repair stations and request revocation of repair station certification by the FAA.
November 16, 2009 -- The Transportation Security Administration (TSA) announced publication in the Federal Register of a Notice of Proposed Rule Making (NPRM) to strengthen the Aircraft Repair Station Security program. The proposed rulemaking would establish security requirements for maintenance and repair work conducted on aircraft and aircraft components at domestic and foreign repair stations certificated by the Federal Aviation Administration (FAA).
The TSA states that the increased security protections proposed in the NPRM are designed to build on the extensive certification and safety requirements for repair stations instituted by the FAA. Aircraft repair stations vary widely in size, type of repair work performed, number of employees and proximity to an airport.
"This proposed rule supplements FAA requirements that protect aircraft undergoing repairs from terrorist threats," says TSA Office of Security Operations Assistant Administrator Lee Kair. "By enhancing repair station security, this rulemaking guards against the potential threat of an aircraft being destroyed or used as a weapon."
The NPRM requires FAA-certificated foreign and domestic repair stations to adopt and carry out a standard TSA security program to safeguard the security of a repair station, the repair work conducted, and all aircraft and aircraft components at the station.
The program will require certificated stations to implement strict access controls, provide security awareness training, and allow for Department of Homeland Security (DHS) inspections.
The NPRM fulfills the Vision 100-Century of Aviation Reauthorization Act's requirement for DHS to put forth security regulations for domestic and foreign aircraft repair stations. In 2003, Congress enacted Vision 100–Century of Aviation Reauthorization Act (Vision 100), Pub. L. 108-176, (117 Stat. 2490, December 12, 2003). Vision 100, which was signed into law by President George W. Bush on December 12, 2003, expands TSA’s authority to address the security of the civil aviation system by requiring TSA to issue final regulations to ensure the security of both domestic and foreign aircraft repair stations.
The public has 60 days to comment on the NPRM once published in the Federal Register.

Washington, D.C. — The Aircraft Electronics Association (AEA) says it has submitted comments to the Federal Aviation Administration last week in response to the FAA’s safety management systems proposed rulemaking.
According to an AEA release, "The AEA does not support the FAA’s broad-based proposal to mandate an independent safety management system for maintenance organizations. The AEA believes the SMS proposal is an excessive, unwarranted and unjustified administrative burden."
"The AEA supports aviation safety, and believes the proposal makes sense for the airlines; however, while the regulations could benefit from some of the elements of SMS, the proposal does not make sense for single-tiered companies."
The AEA release reads: "Collecting data on an unbound “concept,” such as safety management systems, is unrealistic until the agency further defines the intended scope of the program. Based on the FAA’s previous history, the administrative burden on maintaining an independent program is indefinable and excessive. An integrated approach to upgrade the current regulations to include the elements of SMS is the only manageable approach. In addition, the agency has not clearly defined the hazard SMS is intended to address, but rather defines SMS to address “unknown” hazards. This mandate is not within the scope of current rulemaking practices.
"Similar to its current management of manuals and programs repair stations must maintain, the FAA is incapable of estimating any reasonable amount of administrative burden of developing, approving and managing an independent SMS program."

FAA Approves Plan for Southwest Airlines to Replace Unapproved Parts
WASHINGTON, D.C. — The FAA today approved a plan that would require Southwest Airlines to replace unapproved parts installed on about 50 B-737 airplanes and for these aircraft to undergo inspections until fixes are made. The airline already has replaced parts on 30 other planes.
An FAA technical review has determined that the unapproved part would not prevent safe operation of the airplanes. The aircraft manufacturer has made a similar determination. As a result, the FAA has determined that the airline may continue to operate aircraft with the unapproved part until the parts can be replaced, on the condition that each plane must be physically inspected for wear and tear every seven days and the affected parts must all be replaced with an approved part by December 24, 2009.
The FAA has also directed Southwest Airlines to locate and dispose of any other unapproved parts made by the same vendor and to report on the results of its aircraft inspections to the FAA on a daily basis.
The unapproved parts are associated with the hinge fittings for the exhaust gate assembly, which help protect the aircraft flaps from engine heat. The FAA determined on August 21 that the parts had been installed on a number of Southwest Airlines planes. The FAA has opened an investigation into this issue.

PAMA President and Chairman Discuss the separation of PAMA from SAE PAMA publishes FAQ sheet to answer questions about the separation and PAMA's future!
June 17, 2009 - In an Interview with D.O.M. magazine this morning, Clark Gordon, chairman of PAMA, and PAMA president John Casker discussed PAMA's decision to separate from SAE. PAMA has been an affiliate organization within SAE for the past 3 1/2 years. PAMA was scheduled to make a decision to fully integrate into SAE by 2011. However, earlier this year SAE asked PAMA to move up that decision. According to Gordon, the full integration of PAMA into SAE would have resulted in the dispersion of PAMA management with no central nucleus from which PAMA could manage its operation. The PAMA board of directors made the decision to separate from SAE, and the association will hire an association management firm to meet the needs of its members and chapters. PAMA plans to have its headquarters based in the Washington, DC area.
Gordon stresses that the SAE affilliation has been a very good relationship. "We continue to have a good relationship with SAE and they have been very generous to PAMA over the past three 3 1/2 years!"

House Passes FAA Funding Bill; AEA Disappointed with Language for Repair Stations
